Medical malpractice and negligence can occur in and a variety of ways. But a doctor's negligence is the common thread in all of them. When a doctor or hospital deviates from the standard of acceptable medical care and acts negligently or with gross negligence, any resulting injuries could be the basis for a medical malpractice negligence claim. Of course your lawyer must prove causation: that is it must be shown that the actions or failure to act on the part of the medical provider was the actual cause of the harm.

Examples of malpractice can include:
- failure to diagnose an illness or cancer
- failure to preventing surgical infection
- leaving a medical device implanted after surgery
- surgery without informed consent
- certain birth injuries: cerebral palsy, erb's palsy ...

There are many other forms of malpractice. If you have been injured the burden of proof is upon you to prove a doctor's negligence. This is best accomplished by obtaining medical records as early as possible in the process. Many times the records will form the basis upon which a lawsuit was filed.

If you are your loved ones have been injured by the negligence of a doctor or medical care facility our attorneys may be able to help you.
